ACCEPTABLE USE POLICY

ARTICLE I

PURPOSE AND APPLICABILITY

This Acceptable Use Policy (the "AUP") establishes the rules, restrictions, standards of conduct, and usage requirements applicable to all access to and use of DomainsNoBroker.com and all related websites, applications, systems, services, software, communications platforms, databases, and technological infrastructure operated by DOBYOW LLC ("Company," "DomainsNoBroker," "we," "our," or "us") (collectively, the "Platform").

This AUP applies to all visitors, users, buyers, sellers, subscribers, advertisers, contractors, affiliates, agents, representatives, and any other individuals or entities utilizing the Platform.

Compliance with this AUP constitutes a material condition of access to and use of the Platform.

Any violation of this AUP may result in suspension, restriction, removal of content, termination of accounts, denial of services, legal action, referral to governmental authorities, or any combination thereof.


ARTICLE II

GENERAL USER OBLIGATIONS

Users shall utilize the Platform in a lawful, ethical, responsible, and commercially reasonable manner.

Users shall comply with all applicable laws, regulations, court orders, governmental requirements, intellectual property laws, consumer protection laws, privacy laws, sanctions programs, and contractual obligations applicable to their activities.

Users shall refrain from engaging in conduct that may harm the Platform, its users, the Company, third parties, or the integrity of the domain name marketplace.

The Company reserves the right to determine, in its sole discretion, whether any conduct violates this AUP.


ARTICLE III

PROHIBITED FRAUDULENT ACTIVITIES

Users shall not engage in any fraudulent, deceptive, misleading, dishonest, manipulative, or unlawful conduct.

Without limitation, Users shall not:

misrepresent ownership of any Domain Name;

submit fraudulent listings;

falsify traffic data;

falsify revenue data;

falsify valuation information;

impersonate any individual or entity;

misrepresent identity or authority;

engage in phishing schemes;

engage in identity theft;

engage in financial fraud;

engage in wire fraud;

engage in payment fraud;

engage in escrow fraud;

engage in chargeback abuse;

engage in deceptive trade practices;

engage in market manipulation;

engage in any activity intended to mislead buyers, sellers, or the Company.

Any suspected fraudulent activity may be investigated and reported to appropriate governmental authorities.


ARTICLE IV

DOMAIN NAME OWNERSHIP REQUIREMENTS

Users shall not list, advertise, market, promote, transfer, license, lease, or otherwise offer any Domain Name unless they possess lawful authority to do so.

Users represent and warrant that all Domain Names listed through the Platform are owned or controlled by the User or are listed with proper authorization.

The Company reserves the right to request ownership verification documentation at any time.

Failure to provide satisfactory evidence of ownership may result in suspension or removal of Listings and Accounts.


ARTICLE V

INTELLECTUAL PROPERTY PROTECTION

Users shall respect the intellectual property rights of others.

Users shall not utilize the Platform to:

infringe trademarks;

infringe copyrights;

misappropriate trade names;

violate rights of publicity;

engage in cybersquatting;

engage in typosquatting;

engage in bad-faith domain registrations;

engage in trademark dilution;

engage in unfair competition;

or otherwise violate intellectual property laws.

The Company reserves the right to remove Listings or suspend Accounts where intellectual property concerns arise.

The Company may cooperate with rights holders, registrars, registries, arbitration providers, courts, and governmental authorities in connection with intellectual property disputes.


ARTICLE VI

PROHIBITED CONTENT

Users shall not publish, upload, distribute, transmit, display, promote, or otherwise make available content that:

is unlawful;

is fraudulent;

is defamatory;

is libelous;

is threatening;

is harassing;

is abusive;

is discriminatory;

is obscene;

is pornographic;

promotes violence;

promotes illegal activity;

contains malicious code;

contains deceptive information;

violates intellectual property rights;

violates privacy rights;

violates publicity rights;

or otherwise violates applicable law.

The Company reserves the sole and exclusive right to determine whether content is prohibited.


ARTICLE VII

CYBERSECURITY AND SYSTEM INTEGRITY

Users shall not engage in conduct that may compromise, disrupt, impair, interfere with, exploit, circumvent, or adversely affect the security, functionality, stability, integrity, or operation of the Platform.

Prohibited conduct includes:

unauthorized access attempts;

credential harvesting;

password attacks;

brute force attacks;

phishing activities;

malware distribution;

virus distribution;

ransomware deployment;

network scanning;

penetration testing without authorization;

reverse engineering;

denial-of-service attacks;

distributed denial-of-service attacks;

interference with security controls;

circumvention of access restrictions.

The Company may immediately suspend access upon detecting such activities.


ARTICLE VIII

SCRAPING, AUTOMATION, AND DATA COLLECTION

Users shall not utilize automated systems to access, extract, collect, scrape, harvest, copy, index, monitor, or aggregate data from the Platform without the Company's prior written authorization.

Prohibited activities include:

web scraping;

data mining;

robotic extraction;

automated querying;

bulk data harvesting;

crawler activity;

screen scraping;

database extraction;

competitive intelligence gathering through automated means.

The Company reserves the right to block, restrict, investigate, and pursue legal remedies against unauthorized automated activity.


ARTICLE IX

SPAM AND UNSOLICITED COMMUNICATIONS

Users shall not utilize the Platform to transmit, distribute, facilitate, or promote unsolicited communications.

Prohibited activities include:

spam;

bulk unsolicited email;

unsolicited SMS messages;

robocalls;

automated marketing campaigns;

chain letters;

fraudulent solicitations;

misleading advertising;

or other abusive communications.

Users shall comply with all applicable anti-spam laws and regulations.


ARTICLE X

MARKETPLACE MANIPULATION

Users shall not engage in activities intended to manipulate the operation, visibility, ranking, reputation, valuation, search results, or functionality of the Platform.

Prohibited activities include:

fake inquiries;

artificial traffic generation;

fake transactions;

fake reviews;

coordinated manipulation;

false bidding activity;

price manipulation;

misleading valuation practices;

or other deceptive marketplace conduct.


ARTICLE XI

INVESTIGATIONS AND ENFORCEMENT

The Company reserves the unrestricted right to investigate any actual, suspected, or alleged violation of this AUP.

The Company may preserve evidence, review content, analyze account activity, cooperate with law enforcement authorities, and take any action reasonably necessary to protect the Platform.

The Company shall not be obligated to provide advance notice before initiating enforcement measures.

Users agree to cooperate fully with any investigation conducted by the Company.


ARTICLE XII

REMEDIES

Without limiting any other rights or remedies available under law, equity, contract, or policy, the Company may:

remove content;

disable Listings;

restrict functionality;

suspend Accounts;

terminate Accounts;

deny access to services;

cancel subscriptions;

block transactions;

preserve evidence;

report conduct to authorities;

commence legal proceedings;

seek injunctive relief;

recover damages.

The exercise of any remedy shall not preclude the exercise of any additional remedy.


ARTICLE XIII

NO LIABILITY FOR ENFORCEMENT ACTIONS

The Company shall not be liable for any losses, damages, liabilities, costs, expenses, lost profits, lost opportunities, reputational harm, business interruption, or other consequences arising from enforcement actions taken in good faith pursuant to this AUP.

Users acknowledge that enforcement decisions are made in the Company's sole discretion and may be implemented without prior notice where deemed necessary.


ARTICLE XIV

MODIFICATIONS TO THIS POLICY

The Company reserves the right to amend, revise, replace, supplement, or otherwise modify this AUP at any time.

Any modification shall become effective immediately upon publication unless otherwise required by applicable law.

Continued use of the Platform following publication of revised terms shall constitute acceptance of such revisions.

BY ACCESSING OR USING THE PLATFORM, USERS ACKNOWLEDGE THAT THEY HAVE READ, UNDERSTOOD, AND AGREED TO COMPLY WITH THIS ACCEPTABLE USE POLICY.

VIOLATION OF THIS POLICY MAY RESULT IN IMMEDIATE RESTRICTION, SUSPENSION, TERMINATION, OR LEGAL ACTION WITHOUT PRIOR NOTICE.
